BALLOTS are being mailed out via USPS

TO:  Range Rider Homeowner Members,

 

ARTICLE XI, Section 11.2 Term and Amendments states “The covenants and restrictions of this Declaration shall run with and bind the land for a term of thirty (30) years from the date this Declaration is reordered, after which time they shall be automatically extended for successive periods of ten (10) years each, unless seventy-five percent (75%) of the votes outstanding shall have voted to terminate the covenants and restrictions of this Declaration upon the expiration of the initial 30-year period or any extension thereof, which termination shall be written instrument signed by seventy five percent (75%) of the Owners and properly recorded in Bexar County, Texas.”

 

The Covenants were recorded on 14 Jul 1994 which means the 30 year term expires on 14 Jul 2024.  At the annual meeting of members, a motion was passed to put the matter of termination up to a vote of members rather than just allowing it to extend automatically.  A committee was established to determine advantages and disadvantages of terminating or extending the covenants and their report is attached to this ballot.

 

A “yes” vote on this ballot signed by the homeowner will count as a vote to terminate the covenants, conditions and restrictions.  There are 133 members of the association so 100 “yes” votes are required to meet the seventy-five percent (75%) requirement to terminate.

 

A “no” vote on this ballot signed by the homeowner will count as a vote to allow the covenants, conditions and restrictions to automatically extend for a period of ten years.  Since 100 “yes” votes are required to terminate, 34 “no” votes will be enough to extend.

 

Failure to return a signed vote will count as a “no” vote.
